The Delhi Shops and Establishments Act: what applies
Registration: free, online and without renewal
Registration under the Delhi Shops and Establishments Act, 1954 is made online. According to the Delhi Labour Department’s FAQ, no fee is charged, no document has to be uploaded, and the registration certificate can be downloaded immediately after the form is submitted. From 9 December 2025 the rules no longer require the registration to be renewed: the Delhi Shops and Establishments (Amendment) Rules, 2025 omitted Rule 5. The Delhi Shops and Establishments (Amendment) Bill, 2026 would confine the Act to establishments employing 20 or more employees, but by its own terms it comes into force only on a date the Government of NCT of Delhi notifies in the Official Gazette; until that notification, the Act applies as before.
Working hours, leave and records
- Hours: up to 9 hours a day and 48 hours a week, with overtime paid at twice the ordinary rate. Under the OSH Code the general limit is 8 hours a day and 48 a week.
- Weekly closure and opening hours: as provided in the Act and any exemption or permission granted by the Labour Department.
- Records: registers of employees, attendance, wages and leave are kept at the establishment and shown to inspectors on request.
- Wages: at least the Delhi minimum wages; see the minimum wages calculator.
Other employer obligations in Delhi

Where the certificate is used
- Bank account for a proprietorship, where banks ask for proof that the business exists.
- GST registration, as supporting evidence of the business at the premises; see GST registration in Delhi.
- Other licences such as FSSAI for food businesses, and Udyam for MSME benefits.
Common mistakes
- Paying an agent a “government fee”. The Delhi registration is free.
- Not reporting changes. A new address, owner or business should be updated.
- Ignoring the Labour Welfare Fund. It is small, but it is due every six months once there are 5 or more persons.
- Assuming the 2026 amendment is in force. Check the Labour Department’s notifications before relying on the 20-worker limit.

Frequently asked questions
Is Shops and Establishment registration compulsory for a home-based business in Delhi? +
The Act applies to shops and commercial establishments. Whether a home office is covered depends on the facts, such as whether it is open to customers or employs staff. Many proprietors register anyway because banks ask for the certificate.
How long does Delhi shop registration take? +
The certificate is generated online as soon as the form is submitted, according to the Delhi Labour Department.
My old certificate shows an expiry date. Do I need to renew it? +
Renewal was abolished from 9 December 2025, so a registration does not need renewal after that date. Keep the certificate and update any changes in the details.
Is the Shops and Establishment certificate enough for GST registration? +
It supports the application, but GST also needs proof of the premises, such as a rent agreement or ownership document, and the other documents listed for the type of premises.
Do I need to pay professional tax in Delhi? +
No. Delhi does not levy professional tax. Employees working in other States may be subject to that State’s professional tax.
