Quick answers

Which FSSAI registration or licence do I need?

From 1 April 2026: basic registration for turnover up to Rs 1.5 crore; a State licence for turnover above Rs 1.5 crore up to Rs 50 crore; a Central licence above Rs 50 crore, and for specified kinds of business whatever the turnover, such as importers, the e-commerce category in the FoSCoS list, 100% export-oriented units, food businesses at the premises of Central Government agencies, airports and seaports, and the head office of a business operating in two or more States. Check the kind-of-business list on FoSCoS before applying.

What is the FSSAI fee in 2026?

Under the FoSCoS list updated on 1 April 2026, the fee per year is Rs 100 for basic registration, Rs 5,000 for a State licence for most kinds of business, and Rs 7,500 for a Central licence. The registration fee for hawkers (itinerant or mobile food vendors) has been waived since 28 September 2024; petty retailers of snacks and tea pay Rs 100. FoSCoS shows the fee for your category when you apply.

Does an FSSAI licence need renewal?

Under the 2026 reforms approved by the Ministry of Health and Family Welfare, registrations and licences have perpetual validity, so repeated renewals are no longer needed; the yearly fee is still payable. Licences issued earlier with a fixed validity should be checked on FoSCoS for their status.

Every food business operator — a restaurant, cloud kitchen, caterer, sweet shop, grocery or online food seller, manufacturer, importer or trader — needs an FSSAI registration or licence under Section 31 of the Food Safety and Standards Act, 2006 before it starts. Which one depends mainly on turnover and the kind of business: under the FoSCoS eligibility list updated on 1 April 2026, basic registration covers annual turnover up to Rs 1.5 crore, a State licence above that up to Rs 50 crore, and a Central licence above Rs 50 crore or for specified kinds of business. Applications are made online on FoSCoS; in Delhi, State registrations and licences are handled by the Food Safety Department of the Government of NCT of Delhi. SKAG and Associates helps food businesses in Delhi choose the right category, prepare the application and documents, and keep the licence in line with the business.

FSSAI registration and licences: the rules

Registration or licence: the limits in the FoSCoS list of 1 April 2026

TypeWho needs itIssued by
Basic registrationFood businesses with turnover up to Rs 1.5 crore, including small retailers, hawkers, temporary stalls and home-based unitsRegistering authority of the State (Delhi: Food Safety Department, GNCTD)
State licenceTurnover above Rs 1.5 crore up to Rs 50 croreLicensing authority of the State
Central licenceTurnover above Rs 50 crore, and, regardless of turnover, importers, the e-commerce category in the FoSCoS list, 100% export-oriented units, food businesses at Central Government agency premises, airports and seaports, and the head office of a business in two or more StatesFSSAI (Central Licensing Authority)

A business with several premises in different States may need a Central licence for its head office and a State licence or registration for each premises. The kind-of-business list on FoSCoS decides the borderline cases, so check it before applying.

Cloud kitchens and online food sellers

A cloud kitchen or a seller on a food delivery or e-commerce platform needs its own registration or licence for each kitchen or premises; the platform’s licence does not cover the seller. Platforms usually ask for the FSSAI number before listing. Sales through e-commerce operators may also require GST registration whatever the turnover; see accounting and GST for e-commerce sellers.

Validity and renewal

Under the 2026 reforms approved by the Ministry of Health and Family Welfare, FSSAI registrations and licences have perpetual validity, so they no longer need to be renewed at intervals; the fee listed on FoSCoS is a yearly fee. Changes in the premises, products, kind of business or the people in charge must still be updated on FoSCoS, and licence holders file the returns their licence conditions require.

Running a food business without registration

Under Section 63 of the Food Safety and Standards Act, 2006, carrying on a food business that needs a licence without one is punishable with imprisonment of up to six months and a fine of up to Rs 5 lakh. Food safety officers can also act on the conditions of the premises and the food itself.

Common mistakes

 • Choosing the category by guesswork. Importers and some other kinds of business need a Central licence whatever their turnover.
 • One registration for many kitchens. Each premises needs its own registration or licence.
 • Not updating changes. A new address or product category must be added on FoSCoS.
 • Using an old number on packaging. The number on labels and bills must match the current registration or licence.
