Employee Transfer Letter Format
Move an employee to another location, department or function within the same employer, with the effective date and relocation terms.
What it is
A transfer letter records that an employee is being moved within the same employer, to another city, branch, department or function. It states where the employee is moving from and to, any change in designation or reporting manager, the date the transfer takes effect, the last date to join at the new place and any relocation support. It also confirms that salary, service continuity and other benefits are protected unless stated otherwise.

Stamp duty, registration and filing
An employer can transfer an employee only if the appointment letter, service rules or standing orders allow it, or with the employee's consent. A transfer to another State may change the applicable Shops and Establishments Act, professional tax and minimum wage, and may need PF and ESI records to be updated. No stamp duty applies.

Frequently asked questions
Can an employee refuse a transfer?
If the appointment letter or service rules provide for transfers, refusing a reasonable transfer can be treated as a breach. Where there is no such term, the employee's consent is needed.
Does a transfer break continuity of service?
No. A transfer within the same employer keeps service continuous for gratuity, leave and other benefits.
Is relocation allowance taxable?
Reimbursement of actual travel and transfer costs is generally not taxed as salary, but fixed allowances may be. Check the current treatment with your payroll team.
