OSH Code 2020 (effective 21 Nov 2025): Daily working hours capped at 9 hours (some flexibility), weekly cap remains 48 hours. Overtime mandatory at 2x ordinary rate. Aggregate overtime cap raised to 125 hours per quarter (was 50 hours under Factories Act for most cases).

Overtime rules:
  • Trigger: Work beyond 9 hours per day OR 48 hours per week (OSH Code 2020).
  • Rate: 2x the ordinary rate of wages (mandatory across factories, mines, plantations, shops, establishments).
  • Quarterly cap: 125 hours per quarter under OSH Code (up from 50 hours under Factories Act for most cases).
  • Voluntary basis: Overtime cannot be compelled - requires employee consent.
  • Women workers: Can work overtime / night shifts only with consent and provision of safety measures.
  • Records: Register of overtime mandatory; pay slip must show OT hours and rate separately.
  • Exclusions: Managerial / supervisory employees drawing > Rs 18,000/month not entitled (Factories Act); Code on Wages does not exclude.
