What it is

A gift is a voluntary transfer of existing property without consideration, accepted by the donee during the donor's lifetime (Section 122 of the Transfer of Property Act, 1882). Under Section 123, a gift of immovable property must be made by a registered instrument signed by the donor and attested by at least two witnesses.

The deed must be stamped and registered with the Sub-Registrar where the property is situated. Stamp duty is set by the State and is often based on the property's market value; several States charge a lower duty for gifts to close family members. Under income-tax law, a gift of immovable property from a relative (as defined) is not taxed in the donee's hands; from others, the stamp duty value is taxable where it exceeds ₹50,000.

Frequently asked questions

Is registration of a gift deed compulsory?

Yes, for immovable property. Section 123 of the Transfer of Property Act, 1882 requires a registered instrument signed by the donor and attested by at least two witnesses.

Can a gift deed be cancelled?

Generally no. A registered gift that has been accepted cannot be revoked, except in limited cases such as where the parties agreed it could be revoked on a specified event, or where it was obtained by fraud or undue influence.

Is a gift of property from parents taxable?

Gifts from relatives, which include parents, are not taxable in the recipient's hands under income-tax law. Stamp duty is still payable on registration.
