Stamp duty, registration and filing
Whether registration and full stamp duty are needed depends on the wording. The Supreme Court has held that a memorandum recording a family arrangement already made does not need registration, while a document that itself creates or transfers rights in immovable property does. Stamp duty treatment varies by State. Have the deed reviewed before execution, as the wording decides how it is treated.

Frequently asked questions
Is a family settlement deed a transfer of property?
A genuine family settlement is generally treated as acknowledging each member's existing rights, not as a transfer. The exact wording matters for stamp duty and registration.
Who can be a party to a family settlement?
Members of the family who have, or claim, a share in the property. All persons with a claim should join so that the settlement binds everyone.
Is a family settlement taxable under income-tax law?
A genuine family settlement that recognises existing rights is generally not regarded as a transfer, so capital gains usually do not arise. The facts and documentation matter.
