Demotion Letter Format
Record a reduction in an employee's designation or pay, with reasons and the process followed before the decision.
What it is
A demotion moves an employee to a lower position, and sometimes lower pay, because of performance, misconduct or restructuring. Because it affects the employee's rights, it must be handled carefully: the employment terms or service rules should allow it, the employee should be told the reasons and given a chance to respond, and the decision should be recorded. The letter states the old and new designation and pay, the effective date, the reasons and any earlier warnings or improvement plan.
When it is used
- Continued under-performance after a documented improvement plan.
- A penalty after a disciplinary inquiry, where the service rules provide for it.
- Restructuring where the employee accepts a lower role instead of separation.

A unilateral reduction in pay or rank without a contractual basis or a fair process can be challenged, and for a "worker" a change in conditions of service may need notice under the Industrial Relations Code, 2020. Pay after demotion must stay at or above the notified minimum wage. Where the demotion is a penalty, the standing orders or service rules and principles of natural justice apply. Take advice before issuing the letter where the employee disputes the facts.

Frequently asked questions
Can an employer demote an employee without consent?
Only where the employment terms or service rules permit it and a fair process is followed. Otherwise the employee's written consent is needed.
Can pay be reduced on demotion?
It can be revised to the pay of the lower position if the terms permit, but not below the minimum wage.
Should the employee sign the demotion letter?
Yes, where acceptance is required. A signed acceptance shows that the employee agreed to the new terms.
