Sabbatical / Leave Without Pay Approval Letter
Approve an extended unpaid leave in writing, setting out how it affects pay, benefits and continuity, and when the employee returns.
What it is
A sabbatical or leave without pay (LWP) is an extended period away from work, usually for study, health or family reasons, during which salary is not paid. Because it affects pay, statutory contributions and service-linked benefits, the approval should be in writing. The letter records the dates, purpose, the effect on PF, gratuity and seniority, and the conditions for returning, such as notice before return and the role the employee comes back to.

Stamp duty, registration and filing
No wages are paid during LWP, so no PF or ESI contribution arises for that period. Whether the period counts towards continuous service for gratuity depends on the law's definition of continuous service and the leave being authorised, so approved leave is better documented. If the employee does not return on the agreed date, the employer should follow its policy, including notice, before treating it as abandonment.

Frequently asked questions
Does leave without pay break service?
Authorised leave does not generally break continuity of service, though the unpaid period may not count for some benefits. The letter should state the position.
Is PF deducted during a sabbatical?
No. PF is calculated on wages paid, so no contribution arises when no salary is paid.
Can the employee work elsewhere during a sabbatical?
Only if the employer permits it in writing. Most employment terms prohibit other employment while on the rolls.
