Name Compliance Check

Naming rules under Rule 8 (Companies Incorporation Rules):
  • Cannot be identical / too similar to an existing company or registered LLP. Check MCA portal > Services > MCA Services > Company Services > Check Company Name.
  • Cannot include: Words suggesting government patronage (Union, Federal, Republic), names of national heroes / leaders without permission, words like “British India”, “Empire”.
  • Restricted words requiring RBI / SEBI approval: Bank, Banking, Stock Exchange, Mutual Fund, Investment Trust, Asset Management, Stock Exchange, NBFC, MICRO FINANCE.
  • Insurance words: Need IRDAI clearance.
  • Section 8 companies: Must include words like “Foundation”, “Association”, “Federation”, “Council”, “Charities”.
  • Distinctive element required: Generic names like “India Trading” or “National Company” are rejected.
  • Number of words: Recommended 2-4 distinctive words before the suffix.

Reservation process:

  • File SPICe+ Part A (Name Reservation) via MCA V3 portal.
  • Up to 2 names can be proposed (1st choice and reserve).
  • Fee: Rs 1,000.
  • Approval typically within 1-3 working days.
  • Name reserved for 20 days (extendable by 40 days on payment).
  • Cancelled if SPICe+ Part B not filed within reservation window.
