What it is

A rent agreement records the terms on which a landlord lets a residential property to a tenant: the rent, security deposit, duration, maintenance responsibilities and how either side can end the arrangement. Many residential agreements are made for 11 months so that they do not fall within the compulsory registration rule for longer leases.

Under Section 17 of the Registration Act, 1908, a lease of immovable property from year to year, or for a term exceeding one year, must be registered. Stamp duty is payable on the agreement under the State's Stamp Act whether or not it is registered, and the rate and method (stamp paper or e-stamp) differ by State. Some States have their own tenancy laws, so check the local rules before signing.

Frequently asked questions

Why are rent agreements made for 11 months?

A lease for a term exceeding one year must be registered under the Registration Act, 1908. An 11-month agreement is outside that rule, which avoids registration formalities, though stamp duty is still payable and some States have their own registration requirements.

Is a rent agreement on stamp paper valid without notarisation?

Notarisation is not a legal requirement for validity; the agreement must be properly stamped and signed by both parties, preferably with two witnesses. Some offices ask for a notarised copy as a matter of practice.

Does the tenant need the landlord's PAN?

For an HRA claim, employers usually ask for the landlord's PAN when the annual rent exceeds ₹1,00,000. The template has an optional field for it.
