What it is

A resident taxed in India on worldwide income can claim credit for tax paid in another country on the same income, under a tax treaty or the unilateral relief provisions. The claim is supported by a statement of the foreign income and tax: Form 67 under Rule 128 for FY 2025-26, and Form 44 under the Income-tax Rules, 2026 from Tax Year 2026-27. The credit is the lower of the foreign tax and the Indian tax on that income, computed country by country.

Proof of foreign tax paid or withheld is needed, such as a certificate from the foreign tax authority or the payer. Credit is not available for tax that is disputed abroad until it is settled. Check the current rule on incometax.gov.in.

Form 67 applies to FY 2025-26 (AY 2026-27). From Tax Year 2026-27 the statement is Form 44 under the Income-tax Rules, 2026.
